1. Introduction

Welcome to Hard Money Loans of Aspen (the "Site"), operated by Lead Skills, LLC ("we," "our," or "us"). These Terms of Service (the "Terms") govern your access to and use of the Site and any related content, tools, and communications. By accessing or using the Site, submitting an inquiry, or otherwise interacting with us, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

Hard Money Loans of Aspen is a lead-generation and marketing service that connects borrowers with one or more participating hard money lenders and related service providers who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions — including whether to approve a loan, the amount of the loan, and the rates, terms, conditions, and funding timeline — are the sole responsibility of the participating lender. A current list of participating lenders is available upon request.

3. No Offer or Solicitation

The information on the Site is provided for general informational and marketing purposes only. Nothing on the Site constitutes an offer, solicitation, or commitment by us or by any participating lender to make a loan or to enter into any transaction. Submitting an inquiry does not guarantee that you will be matched with a lender, that you will receive a loan offer, or that any offer you receive will be at a particular rate, term, or amount.

4. Eligibility

• •You must be at least 18 years old and legally capable of entering into binding contracts to use the Site.
• •The information you submit must be accurate, current, and complete, and you must promptly update it if it changes.
• •You may not submit inquiries on behalf of another person without that person's express authorization.

5. Your Consent to Be Contacted

When you submit an inquiry and provide the consent requested on our form, you provide your prior express written consent for us and one or more participating lenders to contact you at the phone number and email address you provide — including by autodialer, prerecorded or artificial voice, SMS/text message, and email — regarding your financing inquiry. You understand that your information will be shared with one or more participating lenders who may contact you. Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply, and message frequency varies. You may opt out of text messages at any time by replying STOP, or by contacting us at 970-660-3255.

6. Equal Opportunity

Hard Money Loans of Aspen connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• •Use the Site in any way that violates any applicable law or regulation.
• •Submit false, misleading, fraudulent, or unauthorized information.
• •Attempt to interfere with, disable, or circumvent any feature or security measure of the Site.
• •Use automated means (including bots or scrapers) to access, collect, or harvest information from the Site without our prior written consent.
• •Transmit viruses, malicious code, or other harmful material through the Site.

8. Intellectual Property

The Site and its content — including text, graphics, logos, images, and software — are owned by us or our licensors and are protected by applicable intellectual property laws. You may view and use the Site for your own personal, non-commercial purposes. Any other use, including reproduction, modification, distribution, or republication, is prohibited without our prior written consent.

We do not control those third-party websites or services and are not responsible for their content, accuracy, privacy practices, or terms. Your interactions with any third party, including any participating lender, are solely between you and that third party.

10. Disclaimers

THE SITE AND ALL INFORMATION, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON THE SITE IS COMPLETE OR UP TO DATE. WE MAKE NO WARRANTIES OR REPRESENTATIONS REGARDING ANY PARTICIPATING LENDER OR THE AVAILABILITY, TERMS, OR SUITABILITY OF ANY LOAN PROGRAM.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INTERACTION WITH A PARTICIPATING LENDER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

12. Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. You agree that any action arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Colorado, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version on this page and update the effective date. Your continued use of the Site after the change becomes effective constitutes your acceptance of the updated Terms.
